A mother who was sent death threats by so-called internet ‘trolls’ has won a landmark legal case against Facebook.

Nicola Brookes was tormented for months by anonymous internet bullies after she left an innocent message of support for an X Factor contestant on the social networking site.

She went to police to make a complaint but claimed officers told her to go home.

Now she has won a legal order forcing Facebook to disclose the identities of the trolls. It is the first time an individual has won such an order and Miss Brookes, 45, hopes to pursue private prosecutions against those responsible for her months of ‘vicious and depraved’ abuse.

Charities said the High Court ruling sent a message to the cyber bullies that their anonymity can be stripped away, leaving them open to prosecution.

Campaigners warned that online bullying has become the ‘weapon of choice’ among children and teenagers, with police and prosecutors failing to keep pace with the changes in technology.

Miss Brookes’s ordeal began last November when her daughter told her that an X Factor contestant, Frankie Cocozza, had received hate mail on Facebook. Stung by the cruelty, the mother left a message on his Facebook page, saying simply: ‘Keep your chin up, Frankie, they’ll move on to someone else soon.’

Within minutes bullies on the site turned on her, writing vile abuse including ‘Your [sic] a desperate pedo b****’ and ‘Ur [sic] a ****ing dog’. More than 100 cruel messages were left in just 24 hours. Miss Brookes said: ‘Facebook users began deliberately targeting me, writing under my comment that I was a paedophile and hoping that I would die.’

Worse followed when an online bully set up a fake Facebook profile in Miss Brookes’ name, with her photo and personal email address, and used it to send explicit messages to thousands of children, some as young as nine.

Some messages falsely described her as a drug dealer, a prostitute and a paedophile and known child abuser, and others attempted to ‘befriend’ young girls.

On Mother’s Day this year, trolls published the single mother’s home address in Brighton.

Horrified, she reported the abuse to Facebook and the police, but said officers did nothing to help her. She said one officer told her she could leave a dossier of evidence ‘but we won’t read it’.

Frustrated by their response Miss Brookes contacted lawyers and began legal action to force Facebook to reveal details about her anonymous tormentors.

Last week the High Court granted an order compelling the site to disclose the bullies’ names, email addresses and their computers’ internet protocol (IP) addresses, which can be used to determine a computer’s location.

Miss Brookes said: ‘These abusers are not just random people who have nothing better to do with their time.

‘These are organised people who have been operating on Facebook for years.

‘I’m going for the strongest possible prosecution against these people. I want them exposed.’

Last month, a survey found that just over half of all internet users have received abuse online or by text message. Only a minority report the abuse to police as many believe it will not be taken seriously.

Prosecutions under the Malicious Communications Act, which makes it illegal to send grossly offensive messages, have increased three-fold since 2004. There were almost 900 such prosecutions last year but prosecutors accept that only a minority of trolls are brought to justice.

Miss Brookes has remained on Facebook despite the abuse and said she was determined not to be bullied into quitting the site.

Her legal action would have cost her up to £5,000 but her solicitors Bains Cohen agreed to take the case for free because of her horrific treatment. Lawyer Rupinder Bains said Facebook had not contested the action and had agreed to hand over the information within six weeks.

Four individuals were believed to have led the abuse against Miss Brookes and her lawyers will consider private prosecutions against them. If their Facebook accounts were set up using fake names and email addresses, lawyers will have to return to court and win similar orders against the trolls’ internet service providers, to get the bill-payers’ addresses.

Mr Bains said: ‘It should have been the police’s job to get these details from Facebook but they have completely failed in their responsibility to do that.’

Facebook said it reveals its users’ names and email addresses only if a court orders it to do so. A spokesman said: ‘There is no place for harassment on Facebook, but unfortunately a small minority of malicious individuals exist online, just as they do offline. We respect our legal obligations and work with law enforcement to ensure such people are brought to justice.’

Suzie Hayman, of Bullying UK, said: ‘Bullies hide behind the anonymity of the internet and they should not be able to do so. You can’t be anonymous if you say something hurtful in the office or the schoolyard and people need to learn you can’t be anonymous on the internet either.’

Sussex Police said they had asked Facebook to remove any abusive posts about Miss Brookes and insisted they were investigating the case.

A spokesman said: ‘We need to gather evidence to prove who the person is for a successful prosecution to take place.’

If the DM is so concerned, why are people allowed to add comments on these webpages anonymously?

Forget Facebook and move on!

I can understand prosecuting for making threatening comments, but for being “Grossly offended”? First who decides what’s offensive? The police? A whiny middle aged woman? Secondly don’t we have the right to free speech in this country? If I’m not inciting to commit acts of violence or threatening to do so, why can’t I offend some single mother that watches too much trash tv? I think there are far more important injustices going on in this country and it seems the police agree with me. Just you’ll always find some filthy solicitor to take on cases like this on a “no win no fee” basis no doubt! I say arrest the bloody lawyers!

Good, its about time these vile people were stopped from posting anonymously. Next, those who use the internet for illegal purposes (spam, phishing, dos attacks, hijacking computers, virus injections etc) should also be traced via their originating IP addresses. The right to anonymity should go the moment you use the internet illegally.

I do not believe internet bullying, nor indeed most forms of bullying, have been made crimes. That is why the police cannot do anything. Now she can sue under the civil law, but what is needed is for it to be made a crime, with massive fines and jail time. Before long the bullies would be gone because they are born cowards.

Of course the police are not bothered. There are over 3-BILLION online users each posting thousands of comments a year. That’s TRILLIONS of posts each year. (Are you expecting that to be policed)?
What is this woman going to do when she realizes, the trolls probably live in Botswana. Or post via proxy servers?
This is a complete waste of taxpayers money. And even if she is successful (which is highly unlikely) Do we all want to live in a Police State, where you are scared of saying Boo to a mouse, in case some idiot tries to sue?

Never mind just the Trolls, she should include the police in her private prosecution, for aiding and abetting their crimes.

Jericho teens start the organization to combat growing online problem

Name calling, teasing, shunning. Whatever form it takes, bullying has been an unfortunate rite of passage for many students from the first day of kindergarten to high school graduation. It’s been around in some form, most likely, since the first-ever school opened its doors.

As the decades roll on, so does technology, and schools do their best to try and keep up. Bullying certainly has; it has turned into cyberbullying, with putdowns moving from the playground to the PC and now, Smartphones.

Schools have addressed the issue of cyberbullying, but two local teens decided to take the matter a step further. The End To Cyber Bullying Organization (ETCB) is a non-profit started last year by Jericho High School juniors David Zhao and Samuel Lam. It’s mission is to raise awareness of cyberbullying and offer an array of services to both identify and end the problem for good.

ETCB held a kickoff event March 15 at the Jericho Public Library, where team leaders hoped to recruit volunteers from other area schools, and spread the ETCB word beyond the walls of Jericho. Its founders say the message is most effective coming from students themselves, not just parents and teachers.

“We really need a push from the ranks from below rather than on top,” Lam said. “If we can inspire change from below and get all the kids to join together and start a movement to teach kids that cyberbullying is not a cool thing to do, that is how we can ultimately prevent it.”

ETCB hopes to eventually employ psychologists to provide counseling. For now, it’s all about educating teens and parents on the signs someone is being cyberbullied, and even to make someone aware that he or she is cyberbullying and may not know it.

“We need to define a clear line between teasing, fun and bullying,” Zhao said, adding that 85 percent of teens have been bullied online at some point. “When you’re hurting someone’s feelings, are you having fun? That’s the line we have to clear up.”

What are the warning signs of cyberbullying? ETCB founders say parents should be on the lookout for any behavioral changes in their child, as minor as they may be.

“If they’re a cheerful kid and all of a sudden they’re not…there are very subtle signs and we have to make sure to explore all of them,” Lam said.

ETCB volunteers plan to travel to area schools to give presentations to students and faculty, and then hope to turn things over to the school itself, with chapters staying in touch and banding together for workshops and other events, culminating in the first ETCB gala in the fall.

The group is aiming high, with a movement under way to work with elected officials to enact cyberbullying laws on the state and even the federal level. Again, it all starts in Jericho, and with the volunteers of ETCB.

“That’s how we’re going to solve this problem, by you guys spreading awareness, by you guys starting programs at your schools,” Zhao told the prospective volunteers at the library. “That’s how we will start this movement, with power we’ve never been able to achieve before.”

AUSTRALIA rates number one in the world for bullying on social networks like Facebook, according to a global poll.


While Australia ranked fifth for cyber-bullying overall, nine out of ten parents said when the harassment occurred it was on these types of sites – much higher than the global average of six in 10.

The Ipsos Social Research Institute survey of 24 countries ranked Australia worse for bullying than all of the European countries, along with the US, Britain and China.

The four countries ranking higher than us, in order, were India, Indonesia, Sweden and Canada.

The research comes just a week after Victorian schoolgirl Sheniz Erkan took her own life after being tormented by Facebook bullies.

Ispsos director Ryan Williams said the goal was to find out how prevalent cyber-bullying was and to find out where it was taking place.

“According to parents, Australian children were less likely to experience bullying in an online chat room, via email, or on their mobile phone, compared to global averages – but were more likely than any other nation to experience bullying via social networking sites, such as Facebook,” Mr Williams said.

Australia ranked 15th for mobile devices, 22nd for online chat, 17th for emails, 20th for instant messages, 21st for general websites and 18th for other forms of technology.

No Australian parent reported bullying was a persistent issue with their children.

Kids Helpline manager of strategy and research John Dalgleish said the rise of cyber bullying was a massive concern as it took it harassment from the playground directly into victim’s bedrooms.

Mr Dalgleish said the rise of social networking sites meant bullying was no longer limited to the classroom and teenagers faced further exposure to harassment thanks to the rise of social networking sites such as Facebook.

“Cyber bullying has a profound impact as it widens the audience (from school) and means it can be seen by anyone,” he said.

“It can be used as an extension of face-to-face bullying and takes it from the classroom and into a child’s own bedroom undermining their sense of safety and security.”

KidsHelpline, which offers hundreds of counselling services to bullying victims a year, urged young people affected by the harassment to come forward and speak out.

Mr Dalgleish said victims should tell a trusted adult or parent who can take action on their behalf, and in extreme cases take it to the police.

He added previous studies on the long-term effects of bullying had showed positive outcomes and an end to the behaviour after victims had told someone about it.

“The first thing victims need to know is it’s not their fault,” he said.

“Action can be taken and it can be stopped.”

Bullying can result in chronic anxiety, depression, fear, anxiety, withdrawal from school and in the worst cases, self-harm.

Parents are urged to monitor their children’s social networking use and speak to them about appropriate behaviour on the internet.
